Terms & Conditions

New Home Sales Network™

These Terms and Conditions (“Terms”) govern access to and use of the New Home Sales Network™ platform, services, training, tools, live sessions, certifications, and related offerings (collectively, the “Services”) provided by The New Home Sales Network (“Provider,” “we,” “us,” or “our”).

By accessing the website, enrolling in the Network, or purchasing any Services, you (“Customer,” “Broker,” “Brokerage,” “Agent,” or “Member”) agree to be bound by these Terms.

1. Services Provided

The New Home Sales Network™ provides access to a professional training and intelligence platform that may include, without limitation:

  • Online training content and resource libraries

  • Live training labs, workshops, and market updates

  • Community discussion forums and tools

  • Builder-facing intelligence programs

  • Optional certification programs and events

Access is granted on a per-user (“Seat”) basis and is limited to licensed real estate professionals authorized by the Customer.

2. Pricing, Programs & Founding Access

Pricing, discounts, and promotional programs (including Founding Broker or Pre-Launch offers) are offered for a limited time and subject to eligibility requirements communicated at the time of enrollment.

Founding or discounted rates:

  • Require a minimum number of Seats to remain active

  • Are contingent upon the account remaining in good standing

  • May be voided upon early termination, lapse in service, or non-payment

  • Apply only as long as the applicable program remains active

All pricing is subject to change for new enrollments or additional Seats unless otherwise stated.

3. Deposits & Fees

Certain programs may require:

  • A non-refundable deposit to reserve onboarding or activation windows

  • One-time onboarding or setup fees

  • Fees for optional certifications, events, or add-on services

Any waived or discounted fees may become immediately due upon early termination or failure to meet participation requirements.

4. Billing & Payment Terms

  • Billing is typically processed on a monthly basis via ACH or approved payment method.

  • Annual prepayment options, when offered, are non-cancelable and non-refundable.

  • Customers are responsible for all applicable taxes and pass-through payment fees.

  • Late payments may incur interest at the maximum rate allowed by law.

  • Provider reserves the right to suspend or terminate access for non-payment.

 

5. Term, Renewal & Rate Continuity

  • Unless otherwise stated, Services are provided on a recurring subscription basis.

  • Certain programs may include a minimum commitment term.

  • Subscriptions may auto-renew unless canceled in accordance with the applicable notice period.

  • Discounted or founding rates do not survive early termination or account lapse unless explicitly stated.

 

6. Onboarding, Kickoff & Activation

Some programs require completion of onboarding steps, which may include:

  • Administrative setup

  • Seat roster submission

  • Scheduling or attending kickoff or launch sessions

 

Failure to complete required onboarding steps within the stated timeframe may result in:

  • Loss of promotional pricing

  • Reinstatement of previously waived fees

  • Delayed or suspended access

 

7. Add-Ons & Certifications

Certain Services are optional and priced separately, including but not limited to:

  • Certification exams and credentials

  • Specialized workshops, events, or sponsorships

Certifications are awarded based on participation and performance and are not guaranteed.

 

8. Cancellation, Suspension & Early Termination

  • Month-to-month cancellation may not be available under certain programs.

  • Early termination may require written notice and may trigger:

    • Payment of previously waived fees

    • Repayment of discounted pricing

    • Early exit or shortfall fees

  • No refunds are issued for Services already rendered or prepaid terms.

 

Provider may suspend or terminate access for:

  • Non-payment

  • Policy violations

  • Misuse of the platform

  • Unauthorized sharing of access or content

 

9. No Guarantees or Earnings Claims

The Services are provided for educational and informational purposes only.
Provider makes no guarantees regarding:

  • Income, commissions, sales volume, or ROI

  • Certification outcomes

  • Business performance or results

Any projections, examples, or models are illustrative only and may vary by market, adoption, and individual effort.

10. Intellectual Property

All content, frameworks, trademarks, certifications, and materials are proprietary to the Provider.
No content may be copied, distributed, or reused without prior written consent.

11. Third-Party Information & Builder Data

Information related to builders, communities, incentives, timelines, or inventory may change at any time and is provided “as is.” Provider does not guarantee accuracy or completeness and is not responsible for decisions made based on such information.

12. Limitation of Liability

To the maximum extent permitted by law, Provider shall not be liable for indirect, incidental, consequential, or special damages arising from use of the Services.

13. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles.

14. Modifications

Provider reserves the right to modify these Terms at any time. Continued use of the Services constitutes acceptance of the updated Terms.
